U.S. Supreme Court votes to protect and uphold the Constitution.
You can always tell when the U.S. Supreme Court has done something right. Liberals start squawking - loudly. Recently the highest court in the land ruled that campaign finance restrictions designed to limit corporation and union donations were unconstitutional. Which they were. Such campaign finance restrictions were clearly unconstitutional restraints on free speech.
Contrary to what many liberal politicians and talking heads are claiming - that such a ruling is "judicial activism," or "legislating from the bench," just the opposite is true. "Judicial activism" and "legislating from the bench" occurs when the courts refuse to uphold the Constitution. The U.S. Supreme Courts purpose is to uphold the United States Constitution. More specifically:
"The Supreme Court of the United States of America has but one primary obligation to the American people, and that obligation is to use the power afforded it under Article III – Section I of the Constitution, to uphold, protect and preserve the U.S. Constitution, the Charters of Freedom, and provide equal justice for all, without regard to personal political leanings or ambitions."
It's that simple. And in this case, five of the Justices did their jobs. The five justices that deserve the thanks of the American people include: Justices Anthony Kennedy, Clarence Thomas, John Roberts, Samuel Alito, and Antonin Scalia.
Not surprisingly, the four U.S. Supreme Court justices that voted against upholding the Constitution were the liberals on the bench. Justices John Paul Stevens, Ruth Bader Ginsberg, Steven Breyer, and Sonia Sotomayor. These four did not do their jobs. They were, in fact, trying to "legislate from the bench."
The First Amendment, which was the focal point of the case presented to the Justices, states:
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
The spin coming out of liberal land is that corporations, for decades, have not been considered "human beings." The U.S. Supreme Court struck down this age-old premise. Corporations are indeed human beings. Corporations are individuals, organized into a group, for the purpose of making business decisions. Who runs corporations? People. Who owns corporations? People. Who works for corporations? People.
So what is really going on here? I think that the real outrage coming from the left is that they wanted to corner the market on being able to influence elections and political campaigns. They have been allowed to do so for years. Just look at how, during the Obama campaign, the mainstream media became the Barack Obama Fan Club. They helped Obama get elected, with positive stories, upbeat articles, and support. This type of reporting is still very common today, although the media is finding it more difficult to spin anything Obama and the Democrats are doing in a positive manner. On the flip side, the constant criticisms and slanderous reporting when it came to Republicans like John McCain - and especially Sarah Palin, were all too common. (The venom coming from the media regarding Palin was unprecedented - and for some strange reason has continued ever since the campaign ended!)
Anyhow, a simple question to ask journalists who are aghast at this ruling is: Who do you work for?
The media wants freedom of speech all to themselves - but not for other businesses or unions. Well, guess what? The media - all types across the board - are usually owned by.........corporations! Close to home, the Milwaukee Journal/Sentinel is owned by Journal Communications. A corporation whose stock trades on the New York Stock Exchange. And let's not forget those biggies like the American Broadcast Company (ABC). Or The National Broadcast Network (NBC). Or Turner Broadcasting. Or Hearst Corporation, etc. The list of media corporations is huge.
What the U.S. Supreme Court did on January 21st, 2010, was vote to uphold the United States Constitution. Rather than listening to President Obama, Democratic politicians, and liberal talking heads rip this correct decision to shreds, realize that the agenda of the left is to rip the United States Constitution to shreds.
Coming on the heels of Republican Scott Brown winning in Massachusetts, this decision is yet another step in the right direction! What a great week for America this has been!

In last year's oral argument for Citizen's United, the Court got a preview of how far a ban on corporate-funded speech could reach. Deputy Solicitor General Malcolm Stewart explained that, under McCain-Feingold, the government had the authority to "prohibit the publication" of corporate-funded books that called for the election or defeat of a candidate.
That was a shock and awe moment at the Court, as it also should have been to a Washington press corps that has too often been a cheerleader for campaign-spending limits. Mr. Stewart was telling a truth already familiar to campaign-finance lawyers and the speech police at the Federal Election Commission. Former FEC Commissioner Hans von Spakovsky recalled yesterday that in 2004 the agency investigated whether a book written by George Soros critical of George W. Bush violated campaign laws. Liberals as much as conservatives should worry about laws that allow such investigations.

Liberal democrats don't need Hugo. You guys have the dishonest, corrupt unions to do that for us.

Now they are nervous about this ruling because Obama continues to pisss off every sector of the corporate world but the unions. Gee, who's going to spend the big bucks to remove their biggest enemy.
I do have reservations about what the liberal MSM will do . . . take the money or refuse to run the ads? This will be interesting come time for elections.

As much as you and I may not like some or all of this, freedom of speech is the most important part of our Constitution and the most important element in the right of free men.

If corporations are indeed human beings, then now those select humans that decide where their corporate donations go have twice the influence, once as a citizen and once again as a corporation. CEOs everywhere must be giddy.
Let the bidding begin! Dollars for Democracy?
Don't call it an election call it "free agency" for politicians. No one had better whine about how much is spent by whom ( unions etc..) in this next election now that restrictions are removed. The backroom sweetheart deals and earmarks after 2010 and beyond should be very interesting indeed.

Can you answer this simple question that Jake Picard and other liberals keep running from?
Are you fine with the fact that the unions, SIE, Auto, and Teachers, got Obama elected? Is that OK with you and the current double standard?

I can't see how any American could be comfortble with this ruiling, of course when wining only matters, I guess I can understand why conservatives have no reservations about it, since the drive is the hatred of liberals, by any means, you just sold your souls to the devil.

It's not a one-way street if you take the time to read the facts.

However, the real point of my blog is that the Supreme Court upheld the Constitution! Whether libs like it or not, what they did was the right thing to do. They protected our freedom of speech.
What I really think liberals don't like about this ruling is that they have cornered the market on getting their views out there for so long, ala the mainstream media - they aren't too keen that others may now have a voice, too. (And don't most unions support liberal causes?) What really has changed? Maybe the playing field has become a bit more level - that's all. At least now other groups can get their messages out - using their own money - which must be disclosed - and stating whether or not they support a candidate.
And remember, with the anti-business climate Obama and Dems are creating in our country (including our own Jim Doyle), since they view "profits" as evil, maybe corporations and unions won't even have the money left to spend on campaign ads!. Given the horrible economic climate, with high unemployment and monthly job losses, and Obama & Co. intent on destroying the capitalist system, excess cash to spend on political ads may be hard to come by!

You 2 might as well let approve of China an Hugo Chevez and teh Saudi's influence in our poltics.
Afterall it seems money is your master, money = free speech and you 2 can pay for more of it than I.

"Jacob...what stations will ABC, CBS, NBC, NPR and papers like the NY Times, Milw JS support and endorse? I bet all democrats regardless who is on the ticket. As they have for years

We conservatives have had to deal with NBC, CBS, MSNBC, CNN, Time Magazine, Newsweek, etc. all promoting Barack Obama during the 2008 presidential campaign. They have enjoyed their own "free speech" for years. Now the playing field is a bit more even.

Right on! And the President of the United States, if he wanted to support and uphold the Constitution, should have applauded the courts ruling. Obama's complaining and negative remarks regarding the ruling serve further to support the notion that Obama wants to shred our Constitution, not uphold it. Despicable.
