Ex-City of Pewaukee police chief loses appeal
Former City of Pewaukee Police Chief Gary Bach lost his appeal of a circuit court decision earlier this year that dismissed his lawsuit claiming former members of his department allegedly conspired to have him fired. The state Court of Appeals Wednesday affirmed a January decision by Waukesha County Circuit Court Judge Michael O. Bohren to dismiss the lawsuit Bach brought against Lt. John Kopatich, Officer Robert Kraemer and Officer Kelly Treece, along with Kraemer’s wife, Debbie. Bach alleged in the lawsuit filed in 2008 that audio recordings made by Kopatich at Bach’s residence in December 2006 were used to get Bach fired. Kopatich later played the tapes for the Kraemers who in turn played them for Treece, Bach alleged in his suit. Bach also alleged Kopatich violated his privacy rights by recording their conversation. Bach alleged the recording took place in Bach’s private driveway and basement. "Bach’s claims fail for an utter lack of proof," the Appeals court said.
