Highway 164 expansion denied
U.S. District Court Judge Lynn Adelman issued a decision Monday to stop a four-lane expansion project planned for Highway 164 in both Washington and 2 Waukesha1 counties that would pass through Sussex and Lisbon. "I am pleased to report that as co-plaintiffs in this case both the Highway J Citizens Group , U.A. (HJCG) and the Waukesha County Environmental Action League (WEAL) won a big legal victory here," said HJCG Steering Committee Member Jeff Gonyo. Adelman ruled that the defendants, which include the U.S. Department of Transportation, Federal Highway Administration, U.S. Army Corps of Engineers and state Department of Transportation, failed to properly analyze the effects of the project and other reasonable alternatives in lieu of expanding Highway 164 to four lanes. The plaintiffs filed the action in 2005, claiming defendants acted "arbitrarily and capriciously in approving a highway expansion project in Southeastern Wisconsin," according to the federal lawsuit decision. "Judge Adelman’s favorable court decision today 2 effectively1 stops this unnecessary, fiscally irresponsible and environmentally damaging road expansion project in our local communities and also establishes a very positive legal precedent that must be followed on all future proposed WisDOT road projects throughout the State of Wisconsin," Gonyo said.
