Chicken ordinance advances

Town of Delafield - The Plan Commission Tuesday narrowly recommended to the Town Board to approve an ordinance that would allow residents to raise chickens.

The Plan Commission on a 4-3 vote sent the issue to the Town Board which will take up the matter Feb. 14.

Under the ordinance, a resident would be allowed to keep no more than eight chickens, residents would need to get a license, chicken coops must meet double the required setback, no commercial activities will be allowed including the sale of eggs at a roadside stand, the sale of live or dressed chickens, the sale of live chicks or feathers.

The matter of having chickens on a residential property came before the town last year when Terry Mahovey-Ogden of W290 N2171 Happy Hollow Lane, had last year has been raising chickens for seven years.

In researching the matter, the town did realize it had an ordinance that did permit the raising of chickens in certain zoning districts. That ordinance allowed for the raising of "water fowl, minnows, and other similar lowland animals, fowl or fish." Mahovey-Ogden does not live in one of the districts that permits chickens.

The commission agreed to repeal that provision with the intent of replacing it with the new chicken ordinance.

During a public hearing on repealing the existing ordinance, Mahovey-Ogden said the new ordinance would be more restrictive for those living in agriculture districts.

Commissioner Ed Gratz was concerned that repealing the ordinance would take away privileges from those living in the designated districts.

The commission did recommend to the Town Board to repeal that ordinance.
