Man gets probation for house graffiti
Man wrote slurs about Hindu god on friend's house
Waukesha - A Waukesha man was sentenced in Waukesha County Circuit Court Feb. 1 to three months' probation for spray painting graffiti on his friend's house in the City of Delafield nearly one year ago.
Douglas S. McClellan, 23, entered a guilty plea to a felony charge of criminal damage to property before being sentenced.
McClellan told police he was "really drunk" when he spray painted denigrating slurs on Krishna Prasad's residence, 2203 Hillside Drive, March 6, according to the criminal complaint.
Prasad returned home March 6 at about 7 a.m. and saw part of his house had been toilet papered. As he walked around the house he saw spray painted on the west wall the words "India is Gay" and a large section of the trim was painted black, the complaint said.
Obscenities were painted on the house as well as on a shed, the complaint said. Also, on the deck was painted, "Siva (sic) is weak and can't destroy anything," as well as a derogatory statement, the complaint said. Several toilet paper rolls were found around the house and in trees and numerous footprints were found in the snow, the complaint said.
An officer asked Prasad what some of the phrases meant and Prasad said Shiva is Indian for the Hindu god of destruction, the complaint said.
Police determined McClellan was a suspect and that he had been a friend of Prasad's son and had traveled to India in 2008 with the Prasad family, the complaint said. Police questioned McClellan who admitted to painting the house and "thought it was funny." The officer noted McClellan "laughed again" and said "I was really drunk," the complaint said.
Prasad requested $4,750 in restitution to cover the cost of repairs, the complaint said. Court records indicated McClellan had already paid restitution.
Judge William J. Domina stayed a three-month jail sentence, but did order McClellan to write a letter of apology to Prasad.
