Wold hearing closed

Waukesha - A hearing on the medical needs for Darren Wold, convicted of conspiring to kill his ex-girlfriend on Oct. 1, 2009, was ordered closed by a judge Wednesday.

Waukesha Country Circuit Court Judge James R. Kieffer ordered all those not directly named in the case to leave the courtroom.

The Waukesha County Sheriff's Department petitioned the court regarding Wold's medical condition as he went on a hunger strike Nov. 3, the day after a jury convicted him for hiring a hit man to murder Smith, 39, of Oconomowoc.

Deborah Price, of the Waukesha County Corporation Counsel, representing the Sheriff's Department, asked the hearing be closed due to "the personal, private nature" of the case.

While the case was not brought as a mental health issue or as a guardian issue, which require closed hearings, Kieffer admitted he questioned the filing of the case in a criminal court. However, Kieffer said he was "unable to determine which court should handle this. The question is not answered."

Bruce Vielmetti, a reporter for the Milwaukee Journal Sentinel, objected to the closure and asked Kieffer to delay the hearing in order for the daily newspaper to bring in counsel. Kieffer denied Vielmetti's request.

According to court documents filed by the Corporation Counsel, after Wold engaged in a hunger strike his health deteriorated and he was taken to a hospital for emergency treatment four times last month.

On Nov. 22, Kieffer, acting on a petition filed by Price, ordered Wold to be force fed.

Wold, 43, of Lubbock, Texas, was convicted of conspiring with Jack E. Johnson, 67, of Mexico, to hire Justin P. Welch, 28, of California, to kill Smith.

The jury found Johnson guilty and he will be sentenced Friday and Wold is scheduled to be sentenced Dec. 20, but prosecutors would like to have him sentenced sooner. Welch has been sentenced to life in prison with the possibility of parole at age 70.
