Trucking company driven out of Sussex

Lisbon- Falls flap prompts company to move

Village of Sussex — Price Transportation Co. - a trucking business that employees about 40 full-time and contractual employees and has been in the Village of Sussex for 20 years - is moving to Germantown, partly as the result of a land-use flap between the Town of Lisbon and Village of Menomonee Falls.

Terry Price said he will move his company to a Germantown industrial park near Mequon Road and I-45 next week.

Price said the move was necessary because of a dispute between his landlord, Duane Hyland, and the Town of Lisbon over whether Price could continue to operate a truck parking and maintenance facility on Town Line Road, which borders Lisbon and Menomonee Falls.

The dispute was triggered by complaints from Village of Menomonee Falls officials who said the trucking operation was one example of the town's failure to enforce its land-use regulations along Town Line Road.

Village officials have indicated they may attempt to invoke veto powers over land-use, zoning and development decisions made by the town on property that is within a mile and a half of the village's borders.

A state law allows village boards, under some circumstances, to review and veto land-use decisions by town governments.

Village and town officials have been meeting in an effort to resolve any disputes they might have through the establishment of a joint planning committee.

Town officials acknowledged that trucking operations were not defined as a permissible use in the permit issued for the 17-acre parcel Hyland owns south of Hamilton High School.

Town officials said in early June they intended to issue a formal order stopping the truck operations at the site. As of Monday, however, no order had been issued, but Price said he was moving anyway.

"I believe the building inspectors have, or likely will, direct the property owner to have the current use cease operations, as it is not a legal use of the property. We want to be supportive of businesses located within Lisbon, but it is key that they operate within the confines of our ordinances," said Town Chairman Matt Gehrke.

"It is a dispute between my landlord and the town. But I cannot wait to see how it gets settled. I cannot afford to not operate for a single day," Price said.

"It is unfortunate. We have been doing business in Sussex for 20 years. There was only one person complaining. It won't make any difference whether we are in Sussex or Germantown; we are still going to have the same number of trucks that will be using Highway V (Town Line Road) and Silver Spring Drive," Price continued.

"The Village of Germantown welcomed us with open arms. They have called me personally and welcomed me to the village," Price added.

Price said his company owns about 30 large, five-axle dump trucks that are used to serve surrounding stone quarries. The dump trucks, along with a few over-the-road flatbed trailers, are stored at the Town Line Road facility.

Each morning drivers on contract to Price Transportation Co. come to the site to pick up a dump truck for the day's hauling and later return the truck to the facility. The dump trucks and the flatbeds are also maintained at the site.

The company's corporate headquarters, where there are seven full-time employees, is on Main Street in Sussex. The corporate headquarters will move to Germantown, as well as the trucking operations.

Sussex Village President Tony Lapcinski said he was aware through newspaper reports that some neighbors along Town Line had complained about the trucking company operations.

He said the Village of Sussex had similar review and veto powers over town land-use decisions as Menomonee Falls. However, Lapcinski said he did not know the trucking company was headquartered in Sussex.
